Who Can Make a Workers’ Compensation Claim in the ACT?

If you’ve been injured at work in Canberra, your eligibility depends on which system covers your employer: the ACT Workers Compensation Scheme or the Commonwealth Comcare Scheme. You may be eligible for one of the two if you are:

  • All employees, including full-time, part-time, and casual workers are covered under the Workers’ Compensation Act 1951 (ACT).
  • An ACT Government employee.
  • A Commonwealth or federal employee, including defence and national agencies, covered by Comcare under the Safety, Rehabilitation and Compensation Act 1988 (Cth).
  • A contractor or subcontractor, depending on your work contract, who meets the definition of a ‘worker’ under the Workers Compensation Act 1951 (ACT).
  • A dependent of a deceased worker seeking death benefits.

How do I lodge a Workers’ Compensation claim in Canberra?

While the specifics for lodging a workers’ compensation claim through WorkSafe ACT and Comcare are different, the steps are the same. Here’s how to get started:

Step One - Report Your Injury to Your Employer ASAP

Notify your employer of your injury or illness as soon as practicable. Your employer must then notify their insurer within 48 hours for WorkSafe ACT claims. For Comcare, notify your manager or rehabilitation contact promptly.

Step Two - See a Doctor for the Relevant Medical Form

For a WorkSafe claim, you’ll need to request a Certificate of Capacity from your doctor. For Comcare, you’ll need a Medical Certificate in Comcare format.

Step Three - Lodge Your Claim

Once you complete your claim form, give that and your Certificate of Capacity to your employer, who will have seven days to lodge your claim with their insurer. You can also submit your claim directly to Comcare or HR, if eligible.

Step Four - Case is Reviewed

Once your employer receives your claim, they must submit it to their insurer within seven days. Comcare, however, may take up to 30 days (or more) to review your case.

Step Five - Receive Your Outcome

For WorkSafe ACT claims, insurers have 28 days to accept or reject your claim. If your claim is under Comcare, decisions generally take up to 30 days to be made. If you disagree with the decision, it can be reviewed internally or appealed through the Administrative Appeals Tribunal (AAT). In the ACT, return-to-work planning is managed by your employer and insurer, who may coordinate suitable duties or rehabilitation services as you recover.
