Who Can Make a Workers’ Compensation Claim in the ACT?
If you’ve been injured at work in Canberra, your eligibility depends on which system covers your employer: the ACT Workers Compensation Scheme or the Commonwealth Comcare Scheme. You may be eligible for one of the two if you are:
- All employees, including full-time, part-time, and casual workers are covered under the Workers’ Compensation Act 1951 (ACT).
- An ACT Government employee.
- A Commonwealth or federal employee, including defence and national agencies, covered by Comcare under the Safety, Rehabilitation and Compensation Act 1988 (Cth).
- A contractor or subcontractor, depending on your work contract, who meets the definition of a ‘worker’ under the Workers Compensation Act 1951 (ACT).
- A dependent of a deceased worker seeking death benefits.

How do I lodge a Workers’ Compensation claim in Canberra?
While the specifics for lodging a workers’ compensation claim through WorkSafe ACT and Comcare are different, the steps are the same. Here’s how to get started:

Step One - Report Your Injury to Your Employer ASAP
Notify your employer of your injury or illness as soon as practicable. Your employer must then notify their insurer within 48 hours for WorkSafe ACT claims. For Comcare, notify your manager or rehabilitation contact promptly.

Step Two - See a Doctor for the Relevant Medical Form
For a WorkSafe claim, you’ll need to request a Certificate of Capacity from your doctor. For Comcare, you’ll need a Medical Certificate in Comcare format.

Step Three - Lodge Your Claim
Once you complete your claim form, give that and your Certificate of Capacity to your employer, who will have seven days to lodge your claim with their insurer. You can also submit your claim directly to Comcare or HR, if eligible.

Step Four - Case is Reviewed
Once your employer receives your claim, they must submit it to their insurer within seven days. Comcare, however, may take up to 30 days (or more) to review your case.

Step Five - Receive Your Outcome
For WorkSafe ACT claims, insurers have 28 days to accept or reject your claim. If your claim is under Comcare, decisions generally take up to 30 days to be made. If you disagree with the decision, it can be reviewed internally or appealed through the Administrative Appeals Tribunal (AAT). In the ACT, return-to-work planning is managed by your employer and insurer, who may coordinate suitable duties or rehabilitation services as you recover. LHD Lawyers have been a life saver for me. I did try another firm 1st, and they told me I didn't have a case. I felt like I was put into the Too Hard Basket. So I contacted LHD and in about 2-3 days, I had a response saying they could … More help me. Unfortunately, I can not recommend LHD. They submitted an incorrect medical review that they commissioned, which was riddled with obvious errors. From the basics of getting my name wrong, my mode of travel and distance travelled to the … More examination, to my responses to questions and my reactions to the physical examination during the consultation. LHD assured me that this would not have any material impact on my claim. A week before we went to the commission, I was asked where I obtained my bachelor of criminology despite not having one or ever stating that I did. During the hearing, when I was asked to consider the insurers' offer, LHD advised me that under the terms presented, I was entitled to ongoing physio treatment. After settlement, the insurer rejected any further treatment, sighting the flawed report. LHD lodged an appeal that was also rejected. LHD advised me that they were considering the next course of action. I never heard from them again. Despite other reviews stating that they are rude. I did not find that to be the situation with my dealings. They were polite in all my conversations. They simply made basic errors and provided misleading advice during settlement.

I went to another firm the pay out is half a million not 25k the new firm won't stop ringing me and organising things. Every bit of advise was wrong. I made a complaint and the director reviewed it and said it was good enough and they can't assist me. I begged for contact for someone to help. I almost lost my leg in an accident and these guys made me go through additional hell. Please be warned they are hopeless. Once they have the money funds approved they will not speak to you again and won't update anything that eventually tell you sorry we can't help. Trust me just go else where it will be done 10 xquicket and a better result.
